At least since the publication of ChatGPT in November 2022, the debate on the regulation of artificial intelligence (AI) has gained momentum. However, despite the fact that American tech companies dominate the AI market and are far ahead of their European competitors, AI regulation in the European Union is significantly more advanced than in the United States. For example, the Artificial Intelligence Act (AIA) – the European Union’s digital strategy – is in the so-called trilogue and could be passed this year. In the U.S., the initial approach is voluntary self-declarations by tech giants, and despite a flurry of activity by the White House and lawmakers in recent months, concrete action is still a long way off.
What is the current state of the AI regulatory debate in the U.S., and what influence are U.S. tech giants exerting on it? Despite all the differences, is there a possibility of joint transatlantic leadership in establishing global AI standards?
